The Los Angeles City Attorney will not pursue charges against Cuba Gooding Jr. after a woman accused the actor of grabbing her butt at a party.

Law enforcement told TMZ that prosecutors will not pursue charges of misdemeanor sexual battery due to lack of evidence.

Mark Heller, Gooding’s attorney, told the outlet, “Cuba doesn’t recall this case. He’s out every night of his life. He meets so many people. He interacts with so many people—he can’t remember all the people he meets.”

In New York City, Gooding still faces charges where he turned himself over to police on Tuesday.

Over the summer, a woman accused the actor of groping her breast at a New York City bar. Recently, three more women came forward to accuse the actor of a “pattern” of sexual misconduct. Prosecutors say there are 12 additional women willing to testify against the actor.

Gooding faces multiple charges including one count of forcible touching and one count of sexual abuse, both of which are misdemeanors.
