It looks like Gabriel Aubry’s throwing a few punches of his own in court. According to People and TMZ, the model was granted a restraining order against Olivier Martinez yesterday and is now seeking the emergency protective order preventing him from seeing Nahla lifted.
Aubry shared the details of that Turkey Day brawl before the court saying he was attacked by the Frenchman upon dropping off his daughter.
“Mr. Martinez jumped me on the side of my body, and punched me and such that he had taken me down to the ground,” said Aubry. “He continued to punch me at least two or three times, kicked me in the ribs with his knee or foot, and took my head in his hands and slammed it to the concrete drive way. It all happened so fast and so suddenly; I did not see Mr. Martinez’s actions coming, and thus, I was not ready for it and was not able to defend myself.”
Martinez allegedly threatened to kill Aubry and demanded they arrange drop offs in the street moving forward. “I’m not just some f*cking actor, you don’t know me,” Aubry claims Martinez said. “You cost us $3 million. When you see the judge, you’re going to tell him you’re going to Paris or I’m going to kill you.”
As a result of the bloody battle, Aubry suffered a fractured rib, multiple bruises on his face and forehead and an area under his left eye. He also received stitches in three areas in his mouth. He was arrested for a “private persons arrest for battery.”
Martinez was also treated for injuries but was released.
Aubry also claims surveillance video from Berry’s home will prove his case and suggests the tapes be recovered before they’re erased. No one from Martinez’s camp has disputed the claims, but a source close to Berry has a different perspective the events.
