An Ohio mother is fighting to have her 12-year-old son’s permanent record wiped clean after he was suspended from his school for staring too hard at a White classmate during a staring contest.

According to Think Progress, the unnamed boy was having a staring contest with his White female classmate. After school, the girl reportedly went home and said that she felt intimidated and “fearful” by the boy. Her parents contacted school officials, who suspended the boy and made him write an apology letter.

“I never knew she was scared because she was laughing,” he wrote in his letter. “I understand I done [sic] the wrong thing that will never happen again. I will start to think before I do so I am not in this situation.”

The boy’s family filed a lawsuit in an effort to have the suspension removed from his record, citing that it was bogus simply on a “perception he intimated her,” but last week, an Ohio judge denied the request.
