Wal-Mart Line-Cutter Cuts A Plea



UPDATE 11/21/09: The Wal-Mart line-cutter struck a plea bargain with prosecution today.

The agreement states that Heather Ellis will plead guilty to disturbing the peace and resisting arrest. The penalty foe this will be one year of unsupervised probation, anger management courses and four days in jail.

If Ellis does not break the one-year probation, all charges will be erased nothing will be marked on the schoolteacher's permanent record.

Ellis said that this deal proves she is  "taking responsibility for her actions and [hopes] that everyone else involved in the case will take responsibility for theirs."

She was initially charged with resisting arrest, assaulting a police officer, and disturbing the peace. The max sentence for such could have meant 15 years.

UPDATE 11/20/09: The jury on the case of Heather Ellis, the Missouri Walmart line-cutter accused of disturbing the peace, assaulting police officers and resisting arrest, went into deliberation today.  If convicted Ellis could face 15 years in jail.

UPDATE 11/19/09: Heather Ellis, the 24-year-old schoolteacher charged with assaulting police officers, resisting arrest and disturbing the peace at a Walmart in Kenneth, Missouri, claims that she was a victim of racism.

According to CNN, Ellis said that when she changed checkout lines at the Walmart, customers got angry and used racial slurs toward her. One officer apparently told her to "go back to the ghetto."

Police and officers and onlookers have a completely different story, saying that Ellis was out of control that night in 2007. Either way, Ellis, who refused a plea back in 2007 and who now is engaged to a state trooper, could get 15 years in jail for the incident.

10/20/09: Heather Ellis, a college honors student in Missouri, is facing 15 years in prison for allegedly cutting the line at a Walmart. We've all been in the supermarket, our favorite retailer and even the bank, and watched people wiggle past us to be served first. Amazingly, in 2009, we're getting arrested, charged and maligned for cutting?

The case started nearly three years after a Kennett, Missouri-based Walmart employee made the accusation. Ellis and her cousin were searching for the shortest line, so they split up. When her cousin found the shorter line, she joined him. That's when things went awry. A manager and security guard got involved and ultimately, the police were called.

It sounds like 40 years ago when "Dr. King was living. It's unacceptable today," said Rev. Dwight Montgomery of the Southern Christian Leadership Conference in Memphis. Ellis was charged with disturbing the peace, trespassing and two counts of assaulting a police officer. Details surrounding the incident are reportedly unclear.

After rejecting a plea deal on a misdemeanor count, the prosecutor, Stephen Sokoloff, became intent on pushing for a felony trial next month. To make matters worse, the Klu Klux Klan tried to intimidate the family by rallying and making threats. I am so sick and tired of everyone pulling out the race card when they don't get their way. I have been a witness and victim to this abhorrent behavior. It is just plain rude to cut in line, bottom line. If she didn't act so ignorantly this would have never happened. I mean the gall of this chick to just push another person's items out of the way, besides cutting in line. A person needs to ask every person in front of them if it is okay to cut in line. She needed to be taught a lesson which ultimately bought her notoriety, but wasted our tax dollars. I hope she has to pay restitution to the state for the wastefulness of this judicial case and moreover I hope she learned some morals. Like Forest's momma said "Stupid is as stupid does."

 

IF YOU ATTACK POLICE OFFICERS, YOU WILL GO TO JAIL FOR A LONG TIME. She was charged with resisting arrest and assault on two police officers. You people are a bunch of idiots. If this were a white person that attacked police officers, no one would even hear about it. They would be quietly spending thier time in prison, but since she is black, you people think that she is entitled to do whatever she wants without any repercussions. Sorry liberals. You are ruining this country.

 

This is a WASTE of tax payers money and STUPID. Is this even her first offense? You have black people on here cursing her out and agreeing with the judgement.

 

I don't think she should get 15 yrs. but she was RUDE but I do hope that she gets some punishment!

 

I don't believe she should get 15 years. I never said that. I'm just sick of rude people. I'm 2000 mile away, but I still represent my family well.

 

..the way people are blowing this out of proportion absolutely proves that racism is involved..since when does anyone get 15 years for being rude? i'm not saying that she shouldn't be punished..but..she already got enough pusnishment for her crime..why won't the white folks in that town move on and leave her alone? you guess..blacks are not Americans let alone humans to them..it's sad..

First let me say this whole mess has gotten way out of hand. I"m from this small town that the media is dogging right now and let me just say until you live here you don't know what kind of town we are. I do think Heather is guilty the tape clearly shows her pushing the items of another customer aside and if the she wasn't resiting arrest why was the cops trying to get her to the car the way they did. Our Police department was merely doing their job but yet they are in the wrong because a customer at walmart was being beligerent....come on now!! Granted I don't think she will get the full 1 years, i do think some jail time would sufice though due to all the attention just to teach a lesson

 

This is absurd. The judge, I pray viewing this case,needs to represent the true meaning of what our equality rights within the United States law stands for. This should be dismissed and thrown out. She needs to enroll herself into ethics classes and forced to visit alternative school programs, educating others what not to do. Why are we(CNN) discussing foolishness when this should have been settled by "mature" adults now a "civil" judge. Be Real!

 

I'll keep it real here. I might be called out of my name but ask me do I care. 15 years for this is ludicrous! She wont get that many years. maybe probation or a fine, etc. But what I cant seem to understand is...WHY she think she is so special to cut a line???!! You have people minding there business, people acting normal, people doing alittle shopping at wally world, people being civil, THEN THIS!!! I mean GOD D*MN!!!!!!!!! On some honest sh*t, the "B" was probably some ghetto trash and straight triflin!!! And to call this a racism, You gotta be kidding me! I'm saying this because I see this WAAAAAAAY to often at walmart, when I USED to go there, walmart would draw some of the most ghetto, triflin, ignorant black people and some of the most country, ignorant, hillbilli, trailer park trash white people.

Can people just act civil???

 

Come on people. When do we get sentenced to JAIL for being rude and unruly?!!! If this was a white woman we wouldn't even be discussing this. It would be a town rumor for a couple of weeks and that would be the end of the discussion. She would've gotten a ticket and that would be it. This is pure racism. When have you ever heard of someone going to prison over getting unruly with police? They cite you a ticket, you may spend a night in the slammer and that's it. She is being taught a lesson and that is to stay in her place and do not dare offend a white person.

 

I write to you today from Germany. I want to tell you that I read this story on CNN. Many foolish things were said.

1) "Americans are racists." The French do not allow Muslim headscarves in public buildings. The Italians have a crucifix in every public building. In South Africa, not only are they segregated by black and white, but by subcategories of black and brown. This is utter nonsense. Here, we have a myriad of Christian holidays as part of the national calendar and you cannot be forced to work. A fact which does not account for Jewish (I know!) or Muslim (5% of the population) citizens.

2) "This woman did nothing wrong." Anywhere in the world forcing yourself into an established queue (line) and moving someone else and/or their things is rude. She had no right to this action. This is not grade school with "cutsies" and "frontsies" and "backsies". Silliness!

3) "Fifteen years is too long." Since when does the media announce the "probable" sentence as opposed to the most explosive sentence? Never. Not only is fifteen years probably not on the table, she may only do some small amount of jail and mainly probation, not to mention some form of payments.

On the merits, I must say that this looks like a complete non-issue. Her behaviour was abysmal. She acted entitled for no good reason at all beyond her playground-level logic that she had some right to be in the line because her cousin was. You have a nice word for this - horseshit!

All you need to see was her arm moving the products of the other customer over and over again to know she was the aggressor.

 

Don't know why she is claiming racism. Is she saying that she cut the line was an arrogant black woman because the person being checked out and who's items she pushed back was white?

Gimme a break, who in the hell taught these people that its ok to be antisocial and then claim racism. That card is so diluted "it don't carry no mo weight. In fact when its use now the first thing people think is ignorant liar.

 

Miss T, whatever happened to waiting your turn in line. If you're already in line with people behind you, why should your family be able to jump ahead? That's rude and inconsiderate for the people who are already waiting. There's a lot of "rude and inconsiderate" going around these days.

 

Murders don't even get this much attention. We all go to the store with our friends and family and whoever gets to the line first, the other jumps in. Who knows what really happened. But whatever the case, words are not enough to get a felony charge for anything. None of it is worth 15 years. Assault an officer! Where? People are out here raping kids, and God knows what else. First of all it didn't take 5-6 police officers to handle that situation. And second, "IF" any police officer was assaulted, they would have used force to put her in handcuffs, that would have been a visible scuffle in that video. Lying is a sin.
