NOTICE TO ONLINE ENTRANTS
In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for: (i) lost, late, misdirected, damaged, illegible or postage due mail/entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the independent judging organization, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any Sweepstakes it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw the online method of entry if it becomes technically corrupted, (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes), and to select the winner from among all eligible mail-in and online entries received prior to withdrawal.

The Healthy Make It Happen Sweepstakes ("Sweepstakes") begins at 12:01 AM Eastern Time ("ET") on 12/19/08 and ends at 11:59 PM (ET) on 4/4/09 ("Sweepstakes Entry Period").
Sweepstakes is open to legal residents of the 50 United States and the District of Columbia, age 18 or older at time of entry. Void where prohibited by law. Employees of Essence Magazine, a Division of Time Inc., (the "Sponsor"), Pantene, their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies and members of their immediate families (parent, child, sibling and their respective spouses) and same households, whether or not related, are not eligible to enter or win. Sweepstakes governed by U.S. law. Sweepstakes is subject to all applicable federal, state, local laws and regulations.
There are two ways to enter: Method #1: To enter online, visit www.essence.com/pantene and follow all online instructions to complete the Online Entry Form in its entirety and click the submit button to enter. Online entrants are subject to all online notices including, but not limited to, these Official Rules and Sponsor's privacy policy. Online entries generated by a script, macro or use of automated devices will be disqualified. Limit one (1) online entry per person or e-mail address per day. Although subsequent attempts to enter on a given day may be received, only the first entry received from a particular individual email account will be eligible; subsequent attempts to enter in a given day will be disqualified. Online entries must be received by 11:59 PM ET on 4/4/09. Method #2: To enter via U.S. mail, hand print your name and address on a postcard and mail to: Healthy Makes It Happen Sweepstakes, P.O. Box 9323, Medford, NY 11763-9323. Mail-in entries must be postmarked between 12/19/08 and 4/4/09 and received by 4/11/09. Each postcard entry must be mailed separately. Sponsor is not responsible for lost, late, damaged, illegible, garbled, inaccurate, invalid, mutilated, misdirected, undelivered, delayed or postage due mail/entries. No photocopied or mechanically reproduced, altered or incomplete entries will be accepted. All entries, regardless of entry method, become the Sponsor property and will not be returned or acknowledged.
GRAND PRIZE AND ITS APPROXIMATE RETAIL VALUE ("ARV"): One (1) Grand Prize: 3-days/2-nights trip for winner and one (1) guest to New York City (ARV: $4,200.00). Actual value of Grand Prize depends on winner's location and fares at time of departure. If actual value of trip turns out to be less than the stated ARV listed herein, then the difference will not be awarded in cash. Trip includes round-trip coach air transportation for winner and guest from a major U.S. gateway airport nearest to Grand Prize winner's primary residence (as determined by Sponsor) to New York City (or ground transportation if Grand Prize winner resides within a 100 mile radius of New York City); double occupancy, hotel accommodations for two nights; professional hair styling for winner and guest (up to $500) and winner and guest will share a shopping spree valued at $1,000. All meals, ground transportation (other than as noted), taxes, gratuities, incidentals, upgrades, service charges or other expenses not specified herein are not included and are the winner's sole responsibility. All prize details are at Sponsor's sole discretion. Winner and guests must travel together on the same itinerary including same departure and return dates. Travel arrangements must be made through Sponsor's agent on an airline carrier of Sponsor's choice. Winner and guest must travel on dates specified by Sponsor or forfeit all rights to prize. If for any reason whatsoever, winner is unable to travel due to a conflict with the travel dates or after all travel arrangements have been made and paid, the Sponsor shall have no further obligation to the winner. If Grand Prize is forfeited prior to Sponsor finalizing and paying for travel, and there is sufficient time to notify an alternate winner, the prize will be awarded to an alternate winner in a separate random drawing from among all non-winning eligible entries. Winner and guest are responsible for obtaining the proper travel documentation (e.g., valid photo ID) prior to travel. Guest must be a legal U.S. resident, 18 years or older and will be required to execute and return a Liability/Publicity Release prior to travel. A parent or legal guardian must execute any required travel documents on behalf of any traveling minor and must accompany a traveling minor, including winner on trip. Odds of winning depend on the number of eligible entries received, estimated at 1: 5,000.
RANDOM DRAWING: Potential winner ("winner") will be selected in a random drawing from all eligible entries received. Random drawing will be conducted on or about 4/14/09 under supervision of an independent judging organization ("judges") whose decisions are final and binding. Winner will be notified by mail and will be required to complete and return a notarized Affidavit of Eligibility and Liability and where permissible, a Publicity Release ("Affidavit/Release"), within seven (7) days of date specified on notification, or an alternate winner will be selected. If Affidavit/Release is returned as undeliverable or if the selected winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the prize will be forfeited and an alternate winner will be selected in a separate random drawing. Prize awarded within 30 days after receipt and verification of completed Affidavit/Release. Prize is not redeemable for cash. Prize is non-assignable or transferable. No substitution is permitted except if prize is unavailable, in which case a prize of equal or greater value will be awarded. Any other incidental expenses on prize not specified herein are the winner's sole responsibility. Winner is responsible for all federal, state, local and income taxes associated with winning prize regardless if guest benefits or receives such portion of prize. Winner will be required to furnish his/her social security number for the sole purpose of preparation of any tax forms as required by law. Except where prohibited by law, entry and acceptance of prize constitute permission to use winner's name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission. Prize is guaranteed to be awarded.
Participating entrants agree to these Official Rules and the decisions of the judges and the Sponsor, and release the Sponsor, Essence Magazine, a Division of Time Inc., their parent companies, subsidiaries, affiliates, advertising and promotion agencies and all other businesses involved in this Sweepstakes, as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation, acceptance and use or misuse of any prize. Winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Sweepstakes or use or redemption of any prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize.

Arbitration: This Sweepstakes shall be governed by and interpreted under the laws of the State of Illinois, U.S.A. without regard to its conflicts of laws provisions. By participating, entrants agree that any and all disputes arising out of or relating in any way to this Sweepstakes shall be litigated only in courts sitting in Chicago, IL U.S.A.
