Defense attorneys for William Balfour, the man accused of killing three of Jennifer Hudson's family members, would like to question the singer, reports The Chicago Sun Times.

Amy Thompson, Balfour's attorney, would like the chance to have a "face-to-face" meeting with the Academy Award winner regarding a possible text message exchange with Hudson's mother, Darnell Donerson, before her death.

The news comes as Thompson and prosecutors debate whether there was "enough probable cause" for Balfour's arrest on October 24, 2008 -- the day of the murders.

Balfour's attorney argues he did nothing illegal at the time of arrest, thus they're asking the arrest be dismissed from the case. However, the Assistant State's Attorney, James McKay, is asking the judge to review the police testimonies detailing Balfour's alleged constant threats to kill Julia Hudson in the days before the murders.

He stands accused of slaying Hudson's mother, brother, and her seven-year-old nephew, Julian King.

The trial is set for April.
